ESET is pleased to announce YouTube user MrDanBakst as the Grand Prize Winner of the "What was your life like before ESET?" Contest.

His video was chosen by popular vote from the top 5 finalists. All contestants entered original videos via YouTube showing off what their life was like before ESET.

The Official Rules and Terms of Participation

1. Eligibility
This competition is offered by ESET NORTH AMERICA (ESET) and is open to all legal US residents who are at least 18 years of age at time of entry. Employees of ESET NORTH AMERICA (ESET and/or its affiliated companies and family members of such employees may enter the contest but are not eligible to win.

2. Contest Period

  • You may enter the Contest between 12:00:01 a.m. ET on January 10, 2012 and will end at 11:59:59 p.m. ET on February 10, 2012.
  • The top five (5) finalists will be announced by February 13, 2012.
  • Voting for the grand prize winner will commence when finalists are announced on February 13, 2012. Voting will take place on the ESET website: www.eset.com/contest2012
  • Voting ends on February 17, 2012.
  • The Grand Prize winner will be announced on February 21, 2012.

3. To Enter
To enter the Contest, please go to www.youtube.com/esetusa (hereafter referred to as the "YouTube Channel"), during the Contest Period. In order to participate in this Contest, you are required to register with YouTube and must provide a valid email address. Additionally, to be eligible for the Grand Prize, you must subscribe to the ESET YouTube Channel.

BEFORE YOU WILL BE ALLOWED TO PARTICIPATE, YOU MUST EXPRESSLY AGREE AND CONSENT TO BE BOUND BY THE TERMS OF SERVICE AND PRIVACY POLICY OF YOUTUBE WEBSITE. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE YOUTUBE OR ENTER THE CONTEST.

4. Contest Submission

  • Be creative and create a video showing us or show us what your life was like before ESET.
  • Please don’t include any music unless you created and own the copyright of the music yourself.
  • Please get written permission from everyone in your video to include them in your submission.
  • Please follow YouTube’s Community Guidelines for respectful and appropriate content.
  • The above criteria do not constitute legal advice but is included just for information purposes. Every participant is responsible for their Submission and should ensure that the Submission does not violate or infringe on any laws or third party rights.
  • You are responsible for your video submission ("Submission") and anything in it. Submission means and refers to any and all video content you submit to the contest via the YouTube Channel, including, without limitation, spoken statements, music, audio, video, video recordings, audio- visual works and recordings, slides, portraits, animated and/or motion pictures, caricatures, likenesses, vocal or other sounds, sound recordings and voices.
  • Submission must comply with the YouTube Terms of Service located at http://youtube.com/t/terms.
  • Submission must comply with video requirements located at http://www.youtube.com/t/howto_makevideo.
  • Submission must not to exceed two (2) minutes in length; there is no minimum length requirement.
  • Submission must not exceed 100 MB in size.
  • Submission must be in English or include English subtitles.
  • Submission must have ESET in the title, as well as be tagged with “ESET”. Submission must also use the ESET logo (provided by ESET on contest page).
  • Refer to sections 5 and 6 below for more details regarding the requirements for submitting your video.
  • Members of the public will have the opportunity to view your Submission via YouTube and rate the video using the rating system.

Submit your video: To upload a video to the contest, you must first log in to YouTube. Entries must have ESET in the title, as well as be tagged with “ESET”. Submissions that do not include all required information and adhere to the foregoing and following requirements will be considered void and will not be considered in the judging of the Contest. Entrant must email ESET with true name, YouTube user name, age, mailing address, and email address to be officially entered in Contest and eligible for a prize. ESET is not responsible for participant’s failure to timely complete each step to enter the Contest and submit their video. Once a video is uploaded to the Contest site it is considered final and may not be modified or edited. Video Submissions will not be returned.

LIMIT: Participants may enter the contest multiple times but are only eligible to win one prize per person. Each entry must, however, have at least one email account in order to qualify. In the event of a dispute concerning who submitted the video entry, the entry will be deemed to have been submitted by the authorized holder of the email account from which the entry is assigned by an internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) responsible for assigning email addresses for the domain associated with the submitted email address.

IMPORTANT: ESET is not liable for any disputes between collaborators related to a Submission. Be sure to save your video in the original format after uploading it to the YouTube Contest Channel. If you are a winner, you will need to provide ESET with your video in its original format in order for the submission to be valid. Submissions will be stored by You Tube and made available via You Tube and the site. Members of the public will have the opportunity to view your video contribution via YouTube and rate the video using the rating system.

5. Conditions of Entry
As conditions of entry into this Contest and by uploading and entering a video, Participant warrants and represents that the Submission (a) is original and has been legally created; (b) does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party; (c) has not been entered in or won previous contests or awards; and (d) has not been published or distributed previously in any media.

In addition, the Submission may not contain content which is obscene, crude, vulgar or which contains offensive depictions, images or language; gang signs or symbols; nudity; trespass or the violation of personal rights or property; illegal or inappropriate activity, behavior or conduct; or any other content, material and/or images that could be considered inappropriate, unsuitable or offensive, as determined by ESET in its sole discretion.

Participant represents that he/she owns all rights to his/her Submission, including, without limitation, the copyrights in the recording and the performance contained therein. Participant further represents and warrants that the Participant has obtained permission from each person whose name, image, likeness or voice ("Likeness") is included in the Submission, and that such person(s) have granted Participant all necessary rights to use the person's Likeness as described in these rules, and that Participant can make written copies of such permissions available to the ESET upon request.

If the Likeness of a minor is included, such grant of rights must include written permission from the minor's parent or legal guardian authorizing the use of the minor's likeness on behalf of the minor. By uploading a Submission, Participant irrevocably grants ESET and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Participant's Submission, including, but not limited to, the recording and the performances contained therein (in each case, as submitted or as edited/modified in any way by ESET, in its sole discretion), as well as to use Participant's name, likeness, photograph (collectively, "Likeness"), and/or statements regarding his/her participation in this Contest (with or without using the Participant's name) in any and all media without limitation as to time or territory, and without additional compensation or approval from the Participant or any other party.

Participant waives intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude ESET’s use of the Submission, and agrees not to sue or assert any claim against ESET, and its affiliates, legal representatives, assigns, agents and licensees for the use of the Submission or Participant's Likeness or statements. Participant agrees to indemnify and hold ESET, its agencies and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Indemnities"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Indemnities due to or arising out of the Participant's Submission, or the Participant's conduct in creating a Submission or otherwise in connection with this Contest, including but not limited to claims for trademark infringement, copyright infringement; violation of an individual’s right of publicity or right of privacy; or defamation. Participant further agrees to release ESET from any and all claims that any advertising subsequently produced, presented, and/or prepared by or on behalf of ESET infringes Participant's rights with regard to any elements, characters or ideas contained in any submission.

Furthermore, although ESET is not under any legal or contractual obligation to do so, ESET reserves the right to review and/or edit any and all video elements deemed by ESET, in its sole discretion, to be prohibited, inappropriate, offensive, infringing or otherwise unacceptable. Should ESET edit any such video elements, Participant is not relieved from responsibility for compliance with the YouTube Terms of Use and these Official Rules.

6. Submission Format and Content Requirements
The maximum file size for any Submission is 100MB Video file(s) submitted to your YouTube account must be provided in one of the following file formats: avi, mov, mpg, or wmv. See the YouTube User Terms of Use for additional details.

The video must not exceed two (2) minutes in length, including any tags, and must be in English. Once the Participant completes and submits their video, the Submission is final and may not be modified or edited without permission from ESET. No Submissions will be returned.

When YouTube users identify inappropriate content, as described in our Terms of Use (http://www.youtube.com/t/terms) and Community Guidelines (http://www.youtube.com/t/community_guidelines), they are able to flag the video. Each flagged video is promptly reviewed by YouTube administrators (24hours a day, 7 days a week) who immediately remove any content that violates the Terms of Use. ALL SUBMISSIONS MUST COMPLY WITH YOUTUBE'S TERMS OF USE AND COMMUNITY GUIDELINES, WHICH ARE HEREIN INCORPORATED BY REFERENCE.

7. Judging of Contest Grand Prize Finalists:
Each video entry will be judged by a panel of experts who are employees of ESET or who are designated by ESET to assist in judging (“Judges”). By November 13, 2011, each video will be evaluated by the Judges and finalists will be determined based on the following criteria:

(a) Originality and creativity (50%)

(b) Effectiveness in promoting ESET, LLC. (50%)

The Grand Prize winner will be selected based on a popular vote, to be conducted on the ESET website. Voting will begin on February 13, 2011 and conclude on February 17, 2011. The Grand Prize winner will be announced by February 21, 2011.

ESET may, in its sole discretion, contact any or all of the finalists and Winners via their YouTube accounts in order to confirm the eligibility of those potential finalists and Winners and compliance with the Official Rules. In the event ESET contacts a potential Winner and that potential Winner does not respond within two days, then such Winner will be disqualified and an alternate Winner will be selected from among all eligible entries received based on the judging criteria described herein. Except where prohibited by law, each Winner may be required to sign and return a Declaration of Eligibility and provide any additional information that may be required by ESET. If required, Winners must return all such required documents within two days following attempted notification or such finalist will be deemed to have forfeited the prize and another potential Winner will be selected based on the judging criteria described herein. All notification requirements, as well as other requirements within these Rules, will be strictly enforced.

Determinations of the Judges are final and binding.

8. Prizes
a. First 20 Participants:

Winners are solely responsible for any taxes on their respective prizes. No substitution of prize is offered, except at the sole discretion of ESET. Prizes are non-transferable. If for any reason the Contest is not capable of running as planned, including without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, ESET reserves the right, at its sole discretion to cancel, modify or terminate the Contest. Further, ESET reserves the right, at its sole discretion, to disqualify any individual deemed to be (a) tampering or attempting to tamper with the entry process or the operation of the Contest or ESET or YouTube; (b) violating the Official Rules; (c) violating the You Tube Terms of Service, or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. ESET reserves the right to require winners to submit to a confidential background check to confirm eligibility as a condition of awarding the prize to help ensure that the use of any such person in advertising or publicity for the Contest will not bring ESET into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Contest as determined by ESET in its sole discretion.

9. Notification
ESET will contact the Finalists and Winners via their YouTube account within 30 days of the end of the contest. (Also see 7)

10. Privacy
Any personally identifiable information that you submit to the Contest Site will be used and collected in accordance with ESET’s privacy policy (not YouTube's privacy policy). Any personally identifiable information that you submit in connection with your registration for membership for the YouTube site itself (www.youtube.com) will be used and collected in accordance with YouTube's privacy policy.

11. Limitations of Liability and Release
No liability or responsibility is assumed by ESET resulting from any Participant's participation in or attempt to participate in the Contest or ability or inability to upload or download any information in connection with participating in the Contest. No responsibility or liability is assumed by ESET for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Contest: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any email transmissions to be sent or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or the Web Site; unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Contest, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Contest.

ESET is not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user's own risk. ESET is not responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer equipment resulting from participation in the Contest, use of the Web Site or the download of any information from the Web Site. By participating in the Contest, the Participant releases ESET from any and all claims, damages or liabilities arising from or relating to such Participant's participation in the Contest. By accepting a prize in the Contest, winners agree that ESET shall not be liable for any loss or injury resulting from participation in the Contest, acceptance or use of any prize. ESET is not liable in the event that any portion of the Contest is cancelled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a "Force Majeure Event"). Should a Force Majeure Event occur, ESET may, but is not obligated to, exercise commercially reasonable efforts to air the winning videos at another time or make a reasonable substitution in its sole discretion.

12. Disputes and Jurisdiction
Except where prohibited, Participant agrees that any and all disputes, claims and causes of action arising out of or connection with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a Court in San Diego County, California.
